Terms of Service

"Service" means the Auto VIN Scout platform, including all web pages, APIs, reports, and related features made available at our domain.

"User," "you," or "your" means any individual or entity that accesses or uses the Service.

"Report" means any VIN-based output generated by the Service, including decoded vehicle data, market analysis, flood zone signals, recall information, and inspection checklists.

"Credits" means the consumable units purchased or allocated to your account that are required to generate Reports.

You must be at least 18 years of age and capable of forming a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for use within the United States. Access from other jurisdictions is at your own risk and subject to local laws.

You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at mail@example.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

The Service is licensed, not sold. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes — specifically, evaluating used vehicles prior to purchase or acquisition.

You agree not to:

• Resell, sublicense, or redistribute Reports or any data derived from the Service.
• Scrape, crawl, or use automated means to extract data from the Service without our prior written consent.
• Use the Service to build a competing product or service, or to benchmark against a competing product.
• Attempt to reverse-engineer, decompile, or otherwise derive source code from the Service.
• Circumvent any access controls, rate limits, or credit-gating mechanisms.
• Use the Service in any manner that violates applicable federal, state, or local law.

Certain features of the Service require Credits. Credits are purchased through our payment processor (Stripe) and are non-refundable except as required by applicable law or as expressly stated in a separate written agreement.

Subscription Credits are allocated at the start of each billing cycle and expire at the end of that cycle. Unused Credits do not roll over unless explicitly stated in your plan description. One-time purchase Credits (e.g., Basic Report) do not expire but are non-transferable.

All prices are in USD and exclusive of applicable taxes. We reserve the right to change pricing at any time with at least 30 days' notice for active subscribers. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Reports generated by Auto VIN Scout are informational in nature and are derived from third-party data sources including government databases, market feeds, and FEMA flood zone records. We do not independently verify the accuracy, completeness, or timeliness of underlying data.

Reports are not a substitute for a professional vehicle inspection, title search, or legal advice. A Report should be used as one input among many in your vehicle evaluation process. We expressly disclaim any warranty that a Report will identify all defects, liens, title issues, or risks associated with a vehicle.

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTO VIN SCOUT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

You agree to indemnify, defend, and hold harmless Auto VIN Scout and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.

All content, trademarks, logos, and software comprising the Service are the exclusive property of Auto VIN Scout or its licensors. Nothing in these Terms grants you any right, title, or interest in or to the Service beyond the limited license expressly set forth herein.

You retain ownership of any data you submit to the Service (e.g., VINs you look up). By submitting data, you grant us a limited, royalty-free license to process that data solely to provide the Service to you.

The Service may integrate with or link to third-party services (e.g., payment processors, data providers). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 6–10 and 13–15) shall survive.

You may terminate your account at any time by contacting us at mail@example.com. Termination does not entitle you to a refund of unused Credits except as required by law.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST AUTO VIN SCOUT.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date above and, where appropriate, notify you by email or in-app notice. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
